Terms of Use
These Terms of Service (hereinafter referred to as the “Terms”) set forth the conditions for using the service provided by HotoriSoft (hereinafter referred to as the “Provider”) within the application (hereinafter referred to as the “Service”). Registered users (hereinafter referred to as “Users”) shall use the Service in accordance with these Terms.
Article 1 (Application)
These Terms shall apply to all relationships between the User and the Provider concerning the use of the Service. The Provider may establish various other rules and regulations concerning the use of the Service (hereinafter referred to as “Individual Provisions”) in addition to these Terms. These Individual Provisions, regardless of their names, shall constitute a part of these Terms. If the provisions of these Terms conflict with the provisions of the Individual Provisions stipulated in the preceding sentence, the Individual Provisions shall prevail unless otherwise specified therein.
Article 2 (Changes to the Terms)
The Provider may amend these Terms at any time without notifying Users when deemed necessary. Changes to these Terms shall take effect from the time they are posted on the Service.
Article 3 (User Registration)
For the use of the Service, a registration applicant shall agree to these Terms, apply for registration through the method determined by the Provider, and the registration shall be completed upon approval by the Provider. The Provider may not approve a registration application if it determines that the applicant meets any of the following criteria, and the Provider shall have no obligation to disclose the reasons thereof:
- The applicant has provided false information when applying for registration.
- The application is from an individual who has previously violated these Terms.
- Any other cases where the Provider deems the registration inappropriate.
Article 4 (Fees and Payment Method)
There shall be no charges incurred by Users for using the free features of the Service. Regarding the paid features, Users shall pay the fees specified separately by the Provider and displayed on this website through the payment methods designated by the Provider.
Article 5 (Prohibited Actions)
- When using the Service, Users shall not engage in the following actions:
- Acts that violate laws, regulations, or public order and morality.
- Acts related to criminal activities.
- Acts infringing upon copyrights, trademarks, or other intellectual property rights contained within the Service.
- Acts disrupting or interfering with the functionality of servers or networks belonging to the Provider, other Users, or third parties.
- Commercial use of information obtained through the Service.
- Actions that may disrupt the operation of the Provider’s services.
- Unauthorized access or attempts thereof.
- Collection or storage of personal information of other Users.
- Use of the Service for illicit purposes.
- Actions causing disadvantage, harm, or discomfort to other Users or third parties.
- Impersonation of other Users.
- Advertising, promotion, solicitation, or commercial activities on the Service without Provider’s permission.
- Actions intended to meet or contact strangers of the opposite sex.
- Providing benefits directly or indirectly to antisocial forces in connection with the Provider’s services.
- Any other actions deemed inappropriate by the Provider.
Article 6 (Suspension of Service Provision)
The Provider may suspend or discontinue all or part of the Service without prior notice to Users if it determines that any of the following situations have occurred:
- When performing maintenance, inspection, or updating of computer systems related to the Service.
- If it becomes difficult to provide the Service due to force majeure, such as earthquakes, lightning strikes, fires, power outages, or natural disasters.
- When the computer systems or telecommunications networks stop functioning due to accidents.
- Other circumstances under which the Provider deems it difficult to continue providing the Service.
The Provider shall not bear any liability whatsoever for disadvantages or damages incurred by Users or third parties due to suspension or interruption of the Service.
Article 7 (Usage Restrictions and Cancellation of Registration)
The Provider may restrict all or part of the use of the Service or cancel User registration without prior notice if the User falls under any of the following cases:
- Violation of any provision of these Terms.
- Discovery of false information in registration details.
- Failure to fulfill payment obligations for fees or other charges.
- No response within a designated period to communications from the Provider.
- Lack of use of the Service for a specified period following the last usage.
- Other cases where the Provider deems the User’s continued use of the Service inappropriate.
The Provider shall not bear any liability whatsoever for damages arising from actions taken under this Article.
Article 8 (Withdrawal)
Users may withdraw from the Service through the withdrawal procedures specified by the Provider.
Article 9 (Disclaimers)
- The use of any and all information provided within the Service shall be at the User’s own risk. The Provider shall not be involved nor bear any responsibility whatsoever for any damage, trouble, or litigation incurred by Users arising from the use of such information.
- The Provider shall not bear any liability whatsoever for any damages suffered by Users arising from the use or inability to use the Service, regardless of the reason.
- The Provider does not guarantee the operation of the Service or its compatibility with any device.
- The Provider does not guarantee the absence of bugs or defects within the Service. Furthermore, the Provider shall bear no responsibility whatsoever for damages or disadvantages incurred by Users due to continuous disruptions caused by bugs or defects in the Service.
- The Provider may change or terminate all or part of the Service without prior notice to Users, and shall bear no responsibility whatsoever for damages or disadvantages incurred by Users due to such changes or termination.
- The Provider does not guarantee the completeness, accuracy, legality, usefulness of the Service, nor the accuracy, validity, legality, usefulness, or any other aspects of information obtained through the use of the Service.
- The Provider shall bear no responsibility whatsoever for any damages caused by slowdowns or failures in the Service due to excessive access or other unforeseen reasons.
- The Provider shall bear no responsibility whatsoever for any damages incurred due to modifications, suspensions, interruptions, or termination of the Service.
Article 10 (Modification of the Service)
The Provider may change the contents of the Service or discontinue its provision without prior notice to Users, and shall bear no liability whatsoever for any damages incurred by Users as a result.
Article 11 (Handling of Personal Information)
The Provider shall properly handle personal information obtained through the use of the Service in accordance with the Provider’s “Privacy Policy.”
Article 12 (Notifications and Communications)
Notifications and communications between Users and the Provider shall be conducted through methods specified by the Provider. Unless Users notify the Provider of changes through methods separately specified by the Provider, notifications and communications shall be sent to currently registered contact information, and shall be deemed received by Users at the time of sending.
Article 13 (Prohibition of Transfer of Rights and Obligations)
Users shall not transfer their status under the usage agreement or any rights or obligations under these Terms to third parties, nor shall they provide them as collateral, without prior written consent from the Provider.
Article 14 (Governing Law and Jurisdiction)
These Terms shall be governed by and interpreted in accordance with Japanese law. In the event of a dispute regarding the Service, the court having jurisdiction over the location of the Provider’s head office shall be the exclusive agreed jurisdiction.
